These Terms of Use and Marketplace Terms (“Terms”) are a binding agreement between you and Creative Brains For Marketing LLC (“Drinkszon,” “we,” “us,” or “our”). They govern your access to and use of [DOMAIN], related mobile experiences, accounts, content, marketplace functions, and services (collectively, the “Platform”).

Acceptance of Terms

By accessing the Platform, creating an account, submitting content, applying to sell, or placing an order, you agree to these Terms and the policies incorporated by reference. If you do not agree, do not use the Platform.

Eligibility and Age

• You must be at least 21 years old and legally capable of entering a contract.

• You may not use the Platform on behalf of a person under 21.

• You must provide accurate information and submit to age or identity verification when requested.

• We may refuse, cancel, suspend, or limit access when verification fails or applicable law requires it.

Marketplace Role

Drinkszon may enable independent sellers to offer products. Unless a product page or order confirmation expressly identifies Drinkszon as the seller, the seller identified on the listing is the seller of record. Sellers are responsible for product legality, quality, labeling, warranties, descriptions, fulfillment, recalls, and regulatory compliance. Drinkszon may facilitate listings, payment, customer support, shipping tools, or returns without becoming the manufacturer or seller of every product.

No Guarantee of Availability or Legality

Product availability depends on the product, seller, buyer, destination, carrier, and applicable law. A listing does not mean a product is lawful in every location. You are responsible for confirming that purchase, possession, receipt, and use are lawful where you are located. Our automated restrictions may be broader than the law and are not legal advice.

Account Responsibilities

• Keep credentials confidential and notify us promptly of unauthorized activity.

• Do not create accounts using false identity, location, age, or payment information.

• You are responsible for activity conducted through your account to the extent permitted by law.

Orders and Contract Formation

An order is an offer to purchase. Receipt of an order confirmation does not constitute acceptance. The order is accepted only when the seller or Drinkszon confirms shipment or otherwise expressly accepts it. We may reject or cancel orders for inventory, pricing, fraud, verification, shipping, compliance, or legal reasons. If payment has been captured for a cancelled item, the appropriate amount will be refunded.

Pricing, Taxes, and Errors

Prices may change without notice. Taxes, regulatory fees, shipping, adult-signature fees, and service fees may be added at checkout. We may correct typographical, pricing, description, inventory, or technical errors and cancel affected orders, including after submission.

Prohibited Conduct

• Using the Platform for unlawful resale, diversion, export, trafficking, or delivery to minors.

• Circumventing age, identity, location, purchase-limit, or shipping controls.

• Scraping, copying, reverse engineering, disrupting, or introducing malicious code.

• Submitting false reviews, fake COAs, altered labels, deceptive claims, or infringing content.

• Using products in a way inconsistent with labels, warnings, law, or safe handling instructions.

Product Information and Reviews

Product content may be supplied by sellers. Images may differ from packaging received. Reviews and user content are opinions and are not medical advice or endorsements. We may moderate content but are not obligated to pre-screen every submission.

Intellectual Property

The Platform and Drinkszon content are owned by Drinkszon or its licensors and protected by applicable law. We grant you a limited, revocable, non-transferable license for personal, lawful use. No other rights are granted.

User Content License

When you submit reviews, photos, questions, or other content, you grant Drinkszon a worldwide, non-exclusive, royalty-free, sublicensable license to host, reproduce, adapt, publish, display, and distribute that content for operating and promoting the Platform, subject to our Privacy Policy. You represent that you have the rights necessary to submit it.

Third-Party Services

The Platform may link to or integrate payment, verification, shipping, analytics, seller, or other third-party services. Their terms and privacy practices apply separately. Drinkszon is not responsible for third-party services except as required by law.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” DRINKSZON DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. NOTHING IN THESE TERMS EXCLUDES WARRANTIES THAT CANNOT LAWFULLY BE EXCLUDED.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRINKSZON AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION. DRINKSZON’S AGGREGATE LIABILITY ARISING FROM THE PLATFORM WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO DRINKSZON DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITS DO NOT APPLY WHERE PROHIBITED.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Drinkszon and its affiliates from claims arising from your unlawful use, violation of these Terms, infringement, fraud, circumvention of controls, or resale/diversion of products.

Changes and Termination

We may update these Terms prospectively. Material changes will be posted with a new date and additional notice where required. We may suspend or terminate access when necessary to protect customers, sellers, Drinkszon, or compliance with law.

These Terms of Sale apply to purchases made through Drinkszon and supplement the Terms of Use.

Seller Identification

The product page and order records identify the applicable seller. Keep your confirmation for warranty, return, and recall purposes.

Personal Purchase Only

Unless a seller has separately approved wholesale terms, purchases are for personal, lawful use and not for resale, redistribution, export, or delivery to another person whose age or location has not been verified.

Age and Delivery Verification

You authorize Drinkszon, sellers, carriers, and verification providers to verify age and identity. The recipient may be required to present valid government-issued photo identification and sign for delivery. Orders may not be left unattended when adult signature is required.

Title and Risk of Loss

Title and risk of loss pass as stated by the seller and applicable law. For shipments fulfilled by Drinkszon, risk generally passes upon delivery to the address provided, except where law provides otherwise.

Product Changes and Substitutions

No regulated product will be substituted with a materially different product without consent. Packaging may change if ingredients, net contents, potency, warnings, and product identity remain accurately disclosed.

Recall and Safety Cooperation

You agree to review recall and safety notices sent to the contact information associated with your order and to stop using, isolate, return, or dispose of affected products as instructed. Sellers must fund and administer recalls relating to their products unless otherwise agreed.

Promotions

Promotional codes may have category, seller, geography, quantity, age, or expiration restrictions. Promotions have no cash value and may not be combined unless stated.
